Abstract: Compensationremainsacrucialpreconditionforthecompulsoryacquisitionoflandinmanyjurisdictions acrosstheworld.ThecompensationregimeofGhanaisstillcharacterisedbyuncertaintieswiththe legislativeenvironment.Thispaperfocusedonthedeterminationofrightfulrecipientsofcompensationfor deprivationofuseintroducedbythenewMineralsandMiningAct,2006(Act703)inGhana.Usingcase study andcross-sectionalapproaches, expropriatedfarmers,chiefs,estatevaluationsurveyorsandsome officialsofNewmontGhanaGoldLtdinvolvedinthelandcompensationprocesswereinterviewed.The study examinedthechallengesandprocessesfollowedattheNewmontGhanaGoldLtdAkyemMining Project,wherecompensationfordeprivationofuseoflandwasappliedforthe first timeinGhana.Thestudy revealedthatthemajorchallengeofcompensationrevolvedaroundwhichstakeholderswererightfully entitled toreceivecompensationforthedeprivationoftheuseofland—allodialowners,usufructs,tenant farmersorsharecroppers.Intheabsenceofanyconcretelegislativedirection,alegislativeinstrumentis needed toclearlydefine therecipientsofcompensationunderthevariouspossibleheadsofclaim.
